In no event shall our total aggregate liability to you for all claims arising out of or related to these Terms or our services exceed the greater of: (a) the total amount paid by you to Imos Pizza in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) One Hundred Dollars ($100.00 USD).

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable state law.

7.1 As-Is Basis

THE SITE AND ALL SERVICES, CONTENT, AND PRODUCTS PROVIDED BY IMOS PIZZA ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. 10. Dispute Resolution

We will use good faith efforts to resolve the dispute within thirty (30) days of receiving your written notice. Both parties agree to engage in informal negotiations in good faith before pursuing any formal legal remedies.

10.2 Binding Arbitration

If the parties are unable to resolve the dispute informally within thirty (30) days, you and Imos Pizza agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms, the breach thereof, or your use of the Site through binding arbitration, rather than in court, except that either party may bring claims in small claims court if the claims qualify.

The arbitration shall be conducted by a neutral arbitrator in accordance with the American Arbitration Association (AAA) Consumer Arbitration Rules, which are available at www.adr.org. The arbitrator shall have exclusive authority to resolve all threshold arbitrability issues, including disputes about the validity, applicability, or scope of this arbitration agreement.

The arbitration shall be conducted in English in a location that is reasonably convenient for both parties, or via telephone or video conference as agreed. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

10.3 Class Action Waiver

10.4 Exceptions to Arbitration

Notwithstanding the above, either party may seek emergency equitable relief from a court of competent jurisdiction in order to maintain the status quo pending arbitration, or to protect intellectual property rights. A request for interim measures shall not be deemed a waiver of the right to arbitrate.

11. Term and Termination

11.1 Duration
